Disqualified from Driving?

Driving equates to freedom and to have that freedom taken away under any circumstances can have negative repercussions upon the quality of your life. Your work may have been affected by your disqualification and your family life may have suffered. We fully understand that a disqualification from driving is a serious inconvenience.

Facts

Section 42 of The Road Traffic Offenders Act 1988 allows drivers the right to apply to the court that disqualified them to request the early removal of their disqualification.

If you have been disqualified from driving you can apply to have the disqualification removed within the following timescales:

• 2 years if the disqualification is less than 4 years
• Half of the period of disqualification if the disqualification was for less than 10 years and more than 4 years
• 5 years if the disqualification period was for 10 years or more

N.B. It is not possible to have a disqualification removed when an extended re-test has been imposed as a penalty

Disqualified from driving – The Law

Satisfying the criteria above is the first step in the process of having your disqualification removed. Assuming enough time has passed you are legally able to apply for the early removal of your disqualification. • Your conduct since the disqualification initially
• The circumstances surrounding the offence for which you were disqualified
